Advice needed please. Car pull pulled out on me

Whilst traveling home from work my local road was was closed in one direction. I used the other lane which is closed and has parked cars on it. As I approach the end of the closure I saw a car in a junction, thinking the car seen me I carried on at no more then 12mph, the car then pulled in front of me, I went over the bars and landed on the bonnet head first then rolled onto th road. I ended up with stitches and sore shoulder. Police have just been around after a speaking to her and she is claiming I was traveling very fast, if that was the case why did she still pull out??
So my question is can I claim from her car insurance or worst case my house insurance?

I don't think it matters if you were travelling very fast or not. If it had been a car travelling at 30mph it would still have been an insurance claim. You were hurt, try the driver's insurance. Let them decide and as you were hurt she should have informed her insurance company. Nothing ventured and all that. :cool:0

Why post this twice in different parts of the forum?
If you have 3rd party legal cover e.g. as a member of British Cycling, use their cover if you want to make an injuries claim, if just damages to the bike and gear, claim off her insurance.
Her claiming you were travelling fast is the standard answer for people trying to blame the victim when they pulled out on you (alternative to "didn't see them" aka driving without due care and attention), it's utterly irrelevant if you have right of way and were not breaking the law.
It is a bit confusing in your post though, you said the (presumably left) lane was closed so you went down the right (as in riding into oncoming traffic) because that was also closed?Sam Vimes' Boots Theory of Socioeconomic Unfairness:

She's not helping herself in any way.
Either she didn't look correctly, and pulled out anyway
Or in her claim, she looked, you were traveling very fast then pulled out anyway.
She's probably not looked well, didn't see you, you hit her and rather than accept it was her fault claimed you were traveling so fast it made you invisible.
If you were injured and the bicycle has any damage you can pay a small fee on the MIB database then contact her insurance company to see if they will deal with you directly for a claim. If not, you could try a no win no fee solicitor or similar.All your base are belong to us.0 -

I am a cyclist and driver, I've twice been hit by cars, neither my fault so in normal circumstances you would have my sympathy. However, you have yet to be clear on the actual case:
Were you, or were you not, illegally riding on the wrong side of the road to avoid a road closure? Road closures, like red lights, zebra crossings and one way streets, apply to us as well as cars - if the road is closed, you go around, not ignore the sign and ride up it anyway. If you were riding the wrong way up a closed road there is a fair expectation on the car driver that nothing would be coming out of the road on account of the fact it was closed - a cyclist ignoring the signs and, moreover, riding on the wrong side of the road as a shortcut is doing themselves no favours - the law applies to us as well.Sam Vimes' Boots Theory of Socioeconomic Unfairness:

You want to know if you can claim for an accident - not giving the full information and being evasive about the situation doesn't aid your case.
Riding on the correct side of an open road and a car pulls out into you, open and shut case
Riding on the wrong side of the road down a street that is closed, you take some of the responsibility

Assuming your description of how/where you were riding is correct then hopefully they'll change their mind when they get the drivers side of the storyI must say that some of the comments on here might scare people off from asking questions!!!
