Attachment of earnings on CCJ

I was wanting a bit of advice, I have a CCJ that has just dropped off my file for a Credit Card my ex husband used during our break up. The CCJ has an attachment of earnings on it and it's taking £50 a month from my wage and as a single parent trying to pay that, the mortgage and the bills is very hard. I'm not wanting any sympathy or abusive replies, however does anyone have advice on the best way to go about paying less or hopefully paying nothing at all (wishful thinking)

    Hi,

    You can apply to the court on a form N244 to ‘vary’ or change the order if you find that you cannot afford the deduction rate on the attachment of earnings order because your circumstances have changed.

    You will have to give full details of your budget and why you cannot afford the deductions set by the court. You can also use this form if your circumstances at work change and you want the court to look at suspending the attachment of earnings order.

    I just wanted to add to what is mentioned above. Sourcrates is right and you can apply to vary an attachment of earnings order on an N244, unfortunately, it will cost £255 to do this. You could ask for this fee to be waivered if you are in financial hardship using an EX160 but that will be at the courts discretion as you are working.


    Unfortunately, the fact that the CCJ has come off your credit file doesn't change the fact that the attachment of earnings order will continue to run until the judgement is cleared in full. Make sure you ask for a breakdown of what is still outstanding every 6 or 12months if you haven't received any recent statements from the creditor. Good luck,
