Well yes.
However if it did proceed to the small claims court the employer would have to lie and the judge would have to decide (wrongly), on the balance of probabilities, that the claimant was not telling the truth but making a totally fictitious claim against a random business.
Ultimately the OP is entitled to be paid but only they can decide whether to pursue it beyond a letter before action.0 -
If what you're after is the best for yourself then it is almost certainly not worth the hassle. If what you're after is justice and the principle of the thing, then reporting them to the police for the "illegal work" is surely of greater importantance than your unpaid wages.0

I won't be taking anything to court, it's not worth the hassle. I will write a formal letter to the company requesting for the pay, advising that it will be taken further if not.
