    Therefore they do not need any reason for leaving and is is a simple claim for unpaid wages.

    Well yes.

    However if it did proceed to the small claims court the employer would have to lie and the judge would have to decide (wrongly), on the balance of probabilities, that the claimant was not telling the truth but making a totally fictitious claim against a random business.

    Ultimately the OP is entitled to be paid but only they can decide whether to pursue it beyond a letter before action.

    If what you're after is the best for yourself then it is almost certainly not worth the hassle. If what you're after is justice and the principle of the thing, then reporting them to the police for the "illegal work" is surely of greater importantance than your unpaid wages.

    If you have been asked to do something illegal would have thought would be best to have as limited a connection with them as possible!

    I'm typing with a straight face, honest, but if the OP decides to take it to court, he should remember that he's also entitled to an additional 12.07% for the holiday he accrued on that day.

    I won't be taking anything to court, it's not worth the hassle. I will write a formal letter to the company requesting for the pay, advising that it will be taken further if not.

    Trying is better than not trying at all, thanks for the advice.
