2nd morgage tajen out without my consent help

Hi.. can anyone advise?

Going through a divorce and have 2 small children.

Want to keep the house but can not afford to mortgage alone.

My ex took out a 2nd mortgage to cover HIS credit cards. If i didn't have to pay that 1 too I could afford to stay but of course it's in both our names.

Any way I can make him pay for the 2nd mortgage?

    Taking out a mortgage in your name without your consent is fraud. Are you sure you didn't consent / sign the paperwork?

    If you can prove you werent involved in the 2nd mortgage, you won't have to pay it. But your ex will be in serious legal trouble.

    So when he took out the additional mortgage, did you consent to it being in your name/sign any docs?

    If you didn't know about it, then I'm guessing you need to report this to the police for fraud.

    And the the lender as well.

    But if you simply didn't understand what you were signing, you're out of luck.

  • I will be telling my solicitor th at is dealing with my divorce. We also both have an iva which I'm sure you can't have unless you have a mortgage so it maybe be the things that saves the house... Or at least until the iva is finished! Thank you
