Please help!!! Money gone into bank and NEED IT BACK!! They wont give it!! HELP!!!

I rented a house, then I had to give notice and leave as got accepted for a job abroad, it all fell thru, meaning no job (as resigned from mine-cant go back), no income, no house.

The agency and the landlord refused to work together, and at the end of the tenancy the agency made a HUGE mistake and put the into the wrong bank account.


I gave them the new bank account details via email in advance to pay into via email, the wife received it and never told her husband as they both work for the same company.

The bank said they will have to speak to head manager, to see about encashment as I have told them I need this money for my BR Fee. They want proof from the OR but I have yet to register my BR and needed the money from the deposit to pay for it.
This account is almost 2k overdrawn due to fees by the bank and being unable to pay money in!!
The agency admit made mistake, but will not refund the amount into the other bank account until they see the money go back into their account.

I have NO MONEY!!! am homeless etc, and desp looking for job!!!

what rights do I have?

What else can I do?

Who else can I speak too??

PLEase HELP

    Hi Chester.

    Am I right in thinking that you havn't actually gone bankrupt yet then? If you have then a call to the OR would be most appropriate, if not I think a trip asap to the CAB is on order, have you kept proof that you emailed the agency with your new details?

    I'm not an expert at this but CAB seems the best option?? Someone else who knows for definite will be along shortly

    Thank you claire, not gone thru BR yet as needed this money to pay for it, apparnetly banks have right of appropriation so can keep money.

    should claim back from agency as there error and there fault!!!

    Yes that sounds about right, if you have proof that you emailed them your new details then I think a visit to a solicitor may be in order??
