New employer and previous sick

  • Sadly, if the evidence you have has not been substantiated or endorsed by an independent arbiter then it just becomes a "he said, she said...." scenario.

    What was the official reason for the end of employment? Resignation? Capability process?

    I completely understand how destructive workplace bullying can be but, unfortunately, proving something after the event (and where no formal grievance action was taken) is very difficult.

    I hope you get good news about the job soon.

    Thanks just mentioned what led to the sick leave to explain why my record in that job was bad not planning any further actions against previous employer. In fact the case is so concrete that despite resigning after refusing a GENEROUS settlement (with gagging) 4 months later, no longer in their employ they are still desperately trying to resolve the situation (of their own volition) despite having over a year to do so (that's how long they drug the grievance out).

    Thanks all. Will now concentrate on how to get a job with a poor sick leave record. I'm in a dire situation but it's better than being in the job I was in!

    Now I am confused.

    You need to sort out the loose ends from this situation or it may come back to frustrate future job applications.

    What was the official reason your employment with them ended?

    Why is the company still acting on this even now you are no longer with them?

    What are they likely to provide in the way of a reference?

    You have to see it from their perspective. They advertised a job because they need someone to perform some duties to maximise profits/provide a service they receive funding for. What they don't need is to pay someone to be at home, so of course they are going to be very wary of employing someone with a history of sickness. You say you only had 5 episodes of sickness in the last job, but even that is quite high by the standards of many organisations.

    They are asking you more details because they still want to give you a chance, not to take it away from you. What it comes down to now is whether what you have to offer them is worth them taking the chance that your history of sickness was caused by unacceptable behaviours by your old place rather than a lack of resilience on your part.

    Obviously I would sympathise with the OP if the situation is exactly as she has described. However there are two sides to every story and obviously a potential employer is going to want to, at the very least, hear the other side.

    Sadly there is never an easy answer to these situations. Even if the OP had gone to court, won and "shamed" them in all the papers it would still be likely to put off many potential employers. However unfair that may be it is the hard truth.
