Loans 2 Go - Direct Debit

Hi, I recently took out a loan with Loans 2 Go. On the Credit Agreement it stated that the first payment would be the 14th August, yet they have taken the money out today, the 1st August.

I contacted them and stated that the agreement is for the 14th August, but they said I signed a debit card payment where they can take the money up to or before the 14th August.

I remember signing a Debit Card authorisation form, but I was still told that they would take the money out on the 14th august.

Where do I stand legally? The payment did clear as I had just been paid, but I still think this is wrong.

Take your business to another company, take out another loan and repay this company. They certainly don't sound trust worthy.
Legally..... I would check the T&Cs you signed up to and see what they say

You don't go to companies like 'Loans 2 Go' if you can easily get loans from other companies, especially with an APR of 990%!

What do you remember the Debit Card Authorisation form saying?
"Facism arrives as your friend. It will restore your honour, make you feel proud, protect your house, give you a job, clean up the neighbourhood, remind you of how great you once were, clear out the venal and the corrupt, remove anything you feel is unlike you... [it] doesn't walk in saying, "our programme means militias, mass imprisonments, transportations, war and persecution."

I don't remember, and I do not have a copy. I was surprised that they took the payment out on the 1st, and looked at my Credit Agreement which clearly states that the first payment will be taken out on the 14th August, which was one month from when I signed the agreement.
  • If they took out the payment by Direct Debit, make a complaint to your bank under the DD Guarantee and the money will be returned to your bank. By the time it's sorted, you will probably be at the 14th August.

It's a continuous payment authority the OP has set up rather than a direct debit so unfortunately the payment isn't covered by any kind of guarantee scheme.

They took the payment via my debit card, but surely if your credit agreement says the first payment will be the 14th August, this should be the date they take the first payment?
