BR Questions before SOA

Hi,
I'm hoping someone could answer a few questions before I post my SOA for bankruptcy.
Basically, I have a lot of debt from a previous relationship that I have been struggling with for years. Decided its time to try to sort it given I will be in my 70s before it all gets paid back.
Anyway, just need a few things clarifying before I can sort my SOA.

(1) How would irregular overtime be handled in an IPA? Would the OR just take an average of the previous year or would I just pay over the overtime when I get it?
Some months it can be £100+, others nothing at all.

(2) We claim DLA for my 5 year old autistic son, claim is in wife's name so she could have the option of claiming Carers Allowance.
Would this need to paid over as part if the IPA as we need this for nappies (he's not toilet trained yet), clothes (he goes through a lot) and sensory & learning equipment?

(3) My primary creditor is a Natwest loan for approx. £20k but we also had a joint overdraft with them for about £1300. The last statement they sent me had the amounts added together but it was only in my name. Are they likely to chase my wife for this full amount or is she only liable for the overdraft?

Many thanks in advance.

  • Hi,
Updated to include current SOA and to bump thread. Still hoping for answers for above.
Also, is it possible my wife could qualify for a DRO with her having only income from state benefits?

    Thanks in advance

Are you sure the travel costs cover everything you all need, given that you have no car? Less than £20 pw for five people doesn't sound like much.

Or are some within the disability costs?

    Hi,
Whislt there are people on here who may comment on your Original post above, and they do know what they are talking about, I would advise you to contact one of the debt charities such as Step Change, because you are asking some very specific questions that need specialist indepth knowledge, especially about your son and your expenses for him that in no way should be limited by your bankruptcy.
I found that the SOA in the new online bankruptcy form did not exactly match the type of SOA that MSE gets you to fill in and not all catagories are acceptable in both cases.
Also, whilst not trying to diddle the system, SOA when you are trying to budget your way out of debt, rather than an SOA for bankruptcy are two different things, because for bankruptcy you are trying to use what figures they will allow you to budget for, not what you have to in times of desperation/frugality. For instance, for a family of 5, say you put down groceries as £500/month, OR could say that is not enough, you should put £600. I am not saying that IS the case, but you get what I mean.

On the new online bankruptcy form they have outgoings catagories such as gifts, hobbies, newspapers/stationary, laundry, toiletries, so you see, it is somewhat different from the SOA MSE catagories and things are on there that you might not expect, like newspapers!

    Sorry for long post!
  • Hi.
    Thanks for all the replies.
Ref: Mobile Phones - I know £122 is a lot and I'm fully expecting that to be drastically reduced. Both me and my wife has 11 months left on our contracts so I guess we are in the OR's hands on that one.
House Insurance - We ideally need a policy with accidental damage included because of my autistic son. Again, I guess I might have to convince the OR its required.
I spend £36 a month on transport so the rest is to move my wife and 3 children about. I maybe should push for a little more as my middle child reaches the age he needs to pay for transport in Sept.
I'll try to give Stepchange a call tomorrow and see what advice they can give me.
    Many Thanks.
