Another Update
It seems like an age since I posted on the saga and I see that it is!! But, as I stated, I said it could run and run like a West End farce.
Following the adjournment we got onto the charity who were still willing to help us. There was no problem with that so the ball was back in the Mortgage Co's court.
Firstly they demanded an Income and Expenditure form......we sent them two, one where the second charge was granted and one where it wasn't. We sent them the fee they demanded and, due to obtaining some money from my Mum, we paid them 33% of the debt to show real willing!!
A week later they contacted us and said we hadn't paid the fee....we showed we had. They then asked, yet again, for the terms of the loan we were getting. The day later the charity called us to say the mortgage company had called them to see if the charity could afford the loan!!! The officer concerned with my partner's case told them to **** off as it was none of theur business!!! :rotfl: :rotfl: :T . She said a lot more when the mortgage company demanded the fee off them as well! Now, possibly that was part of the reason the mortgage company declined consent but fair play to the girl...she said to them what we wanted to. Bless her, she had also managed to get a direct dial number that was extremely useful :j . So I used it and, when the mortgage consultant (that's a laugh) came out with the phrase, "what don't you like about our decision" I told him!! It transpires that he did not know that the loan was interest free, did not know that it guaranteed an income for a year and did not know of the views expressed by the Judge. Further, he did not seem to be aware of the exact terms of the loan offered and was not aware of the company he worked for saying that they would deal with the matter sympathetically.
The following day they finally said that no decision had ever been made on the advance and they had granted consent. In response to that they had difficulty in explaining the letter of refusal we received that morning so, um, didn't bother to try. They said they only needed a written agreement from my partner that she would discharge the debt. We gave it willingly and in the exact terms they dictated to us.....................and then, a week later they said it wasn't good enough as they wanted it from our solicitors :mad: . So, we got one from then and finally we were told we could have their consent before Christmas.
We didn't get it until the middle of January!! In the meantime other debts were increasing and those people weren't happy as they had been told we could pay money before Christmas.
The case was finally adjourned for 6 months, to see how we do, last month, but not without the mortgage company writing to the court to say that our arrears were at an acceptable level......despite the fact that there weren't any:mad: :mad: so £0.00 seems pretty damn reasonable to me! We have since paid off a shedload of debt elsewhere and are finally sleeping at night and no-one telephone's us anymore. Those that do we no longer hide from.
So, thanks for all the advice on here, it really was a help and a comfort, knowing that others were going through the same thing (I didn't mean that as it reads!!:embarasse :embarasse ).
Presently I have got my bank offering me a "60% deal" on my overdraft, stating they will pay the other 40% if I pay off the other 60%. We can do that but is it a good idea? It will go on my credit reference as partially settled, which won't bump my 'score 'up that much, I believe, but it does seem a good deal. Am I missing something?

60% deal on your OD seems good but make sure you get it in writing & also it is in full & final settlement.

Ref the offer from the bank about you paying 60%, ONLY agree to this, if they will
a) put it in writing that the debt is settled
b) that it is marked on your credit file as settled
This is because you are right putting that a debt is partially settled won't improve your credit score much. BUT by saying it is only partial settlement, it means that if they feel like it, later they can ask for the other 40% of the debt. Ie unwrite it off. Very sneaky.
So put in writing that you will pay it on confirmation that this is a full and finaly settlement for the debt, and that it will be marked as such on your credit file.
Glad to see that your mortgage company FINALLY saw the light. But it is worrying isn't it. I wonder how many people each year get turned out of their homes when they actually shouldn't be.....

Thanks you two, and yes, Mrs H has got DLA and, as the old car is finally giving up the ghost and I do my best to ensure she gets out as often as possible (although she still manages to find her way home
).
I also agree that it is frightening to think how many people are unfairly and unjustly evicted. On our furst appearance the free legal advice at court (and they do a fantastic job, by and large, under immense pressure) advised us not to apply for an adjournment but to suggest a suspended possession order. I have a feeling that, if we had followed that advice, the mortgage co would have refused permission for the charge and taken the property.
When we were at court I heard a woman explaining to the advisor that she was not behind on her mortgage but had refused to pay an exhorbitant management/service charge. She had informed the mortgage company of her real concerns about the overcharging for the work done. What did the mortgage company do? THEY paid the charge and then sought possession as she had not paid the charge (a condition of her mortgage). I viewed that as being the mortgage company equivalent of a back alley mugging and disgusted me.
As far as my bank is concerned. The letter says
"We are delighted to offer you an excellent opportunity to clear your balance. This is a final opportunity for you to clear your debt at a discounted rate and begin to repair your credit rating. Pay 60% of your debt NOW and we will clear the rest"
They told me, when I called them, that the debt would be marked as partially settled. What should I be asking then to put on my credit file as it appears they will not accept 60% as "full and final settlement".0 -

Sorry to push but the time to accept the offer for the bank runs out on Wednesday. It is the only debt we haven't either paid off or regularised and, obviously, I don't want to !!!! it up now!!!0
