Is it santander chasing you for the original debt? or as i suspect, a debt collection agency who have no rights, they are third party interlopers, living off the misery off people in crisis.

Santander contacted me on the 20th to say it had defaulted and Payment was in arrears then on the 27th a letter from DWF LLP was sent who after researching are a law firm / solicitors. In the letter it states the client as Santander and says judgement was granted at the county court

I'm living with my partner renting but that's all in her name and we are lucky in that she was able to get housing benefit when I became unemployed so at least that is one less stress for the moment.

They can't do a thing to you then.

If you don't own a house, they can't take it, or secure the debt against it.

If your not working, they can't deduct money from your wages at source through an attachment of earnings order.

Can't send bailiffs either, as its not your house.

From an enforcement point of view, there hands are tied, due to your situation.
I would certainly ask for a breakdown of the figure they say you owe, don't forget there will be court costs and interest from the original agreement added also.

Unfortunately I no longer have any of the paperwork but I roughly remember it being£350 a month with something like £600 being the last payment, the full cost of finance was £6600 the solicitors say I now owe £6300 I understand charges apply especially given its a 2 year debt but bearing in mind I had made payments and gave the car back to be sold etc I'm still at the full amount :(

    And thank you :)

With a small final payment of 600 then it's highly unlikely that it was a PCP agreement. If you wish to clear the debt then I would certainly ask for a breakdown. With such a large CCJ, it would be difficult for you to get any credit over the next couple of years so the decision, whether to pay or not is yours to make. There will be differing opinions on this forum about this but definitely seek advice from a professional debt help group.

in the grand scheme of things, please don't let it give you restless nights...nobody has painted a big red X on your door or named you in the papers. Enjoy your new arrival!

I think any credit rating I had is long gone now to be fair :( 2 - 3 years ago I was getting offered credit left right and centre and being younger at the time and immature I thought it was fantastic plus at that time of my life I was in and out of work and was made homeless twice so I suppose I made a lot of mistakes through that. I have other debts but no where near as big as this one.

I can't even get a bank account :( when I was working I had my wages paid into my partners bank

Is there any specific letter I need to send to ask for a breakdown of the debt?

And thank you :o I think it's just a bit embarrassing the situation I've got myself up in but lesson learned!! Even if I could get credit now I wouldn't touch it

Not really, just adapt this to your needs :

    Name
    address
    date

    Dear Sir/Madam,

    Account number : xxxxxxxxx

I write in reference to your recent letter regarding a judgement debt of £6000 you allege is mine.

Please provide me with a full breakdown of how this debt accrued, including any interest or charges added.

    yours sincerely
