I had myself in a bit of bother when i had my son and got CC which in the end couldn't pay and landed myself in a small debt it has been transferred to Res tons Solicitors and have declined my offer of £20 a month repayment and want £75.00 of a £540 debt they are threatening action if i refuse this, what can i do I don't earn a full time wage as i decided to go into an apprenticeship to get qualifications and a possible good job in the future!

Hi Xjennibx,
All you can do is offer what you can afford. Post your SOA and details of any other debts that you may have and then it is easier to guide you. However, if you have done a SOA and this is your only debt and £20pcm is the maximum you can afford, you now need to hold your ground. Send your £20 each month whether it has been formally accepted or not, and continue to write/ email them and ask them to accept it.
If they keep refusing your offer then they may take court action or pass/sell the debt on again. County court is all done through the post, it is very unlikely you will need to attend court and you will very likely make a similar offer on court forms. Reston's is just a debt collector, they cannot enter your home or touch anything, try not to worry about them.

If not, then Restons are just acting as a debt collector for there client.
Doesn't matter what they are asking for, you can only pay what's affordable, start paying the £20 a month and stuff them, if they want to take you to court, you would not pay more than what's affordable, they are just threats made in order to get you to up your offer.

it was a scary letter that they sent and i don't want to incur more charges because they refuse it, I am calling them on lunch but I have been told they are quite bullying! 0
They are threatening action against me but I thought it's £500 i owe, would it be even worth taking me to court for that amount?0 -

They are computer generated template letters, nothing more.

£20 a month on a £540 debt clears it in 27 months - if that's all that is affordable they would get nothing more by taking court action.
I agree with sourcrates - just start making the payments. Don't phone them.
When you say 'threatening action' we are assuming they are threatening a court claim. Tell us if there is already a ccj and they are threatening something else.0 -
It was along the lines of
" Non agreeable to payments of "£20, our client requires payments of £75 a month"
"failure to contact by Friday 5th could result in a County Court Claim"
Please contact the office etc etc.

They can't do anything as they are only acting for there client.
They have no power to do anything as its not there debt !!!
