Can the court do this?

My wife and I were taken to court on Monday 25th July by Linwood Double Glazing.
We had refused to pay our final bill after deposit as the window fitter damaged our expensive flooring and fitted undersized windows. They also fitted doors off plumb and made a hash of every window. They never finished the job never certified.
The court knew all of this as we stated it in our counter-claim.
The Judge commented that Linwood had failed to submit any evidence or statements, and even neglected to file the credit agreement.
So instead of throwing their case out he ordered a survey be completed and for linwood to submit all evidence for a future date. Can this be allowed?

Hi Stuey Anderton,
It sounds as though the court has adjourned the case pending more information, which they are within their rights to do. However, you should, if you haven't done so already, make sure you get some legal advice about what else you can do and/or file, if anything. Good luck,
Laura
