Link Financial CCA Request - Question

Having sent a CCA request to Link Financial for a CCA request, they have responded saying it could take up to 30 days for the request. The debt was bought in 2014 from MBNA and the acccount was from 2009.

I've since searched a bit more for Link Financial and in many cases they hae responded to CCA requests but have also then started to persure the debt in full.

I'm doing this for a friend in terms of handling everything. Should I wait for the CCA request or make a full and final offer now?

Once they have the CCA, does it make the full and final offer more difficult rather than doing it now?

What are you thoughts about them suddenly persueing it?

    When debts are bought and sold, they are done so in bulk, hundreds, thousands at a time, no paperwork gets passed on, the DCA does not know, or care, if its bought enforceable debts or not.
    The only way anybody ever knows if there debt is enforceable, especially with older accounts, that have been passed from pillar to post, is if they make a CCA request.


    The DCA, in your case Link, will go back to the original creditor, and ask for your paperwork, on your behalf, the OC then has to search its files to find a copy of your agreement, if they don't hold enough information on you to make a reconstituted copy, they must tell you so, if they do, then that's what you will get.


    Basically when making full and final offers, lack of a CCA is a bonus to you, as in most cases, they wont be able to pursue the debt through the courts, it is a little more complex than that, and if you want I will explain further, but if they do supply the CCA, then all that will tell you is the agreement is enforceable.


    Just remember DCA`s are in the money making business, as long as they show a profit, they should always be open to a deal.

  • Why on earth would you make an offer to pay, whether the full amount or not, when they may well respond that they cannot trace any details of the original signed agreement?

    You have 30 days, and during that time they can exert all the pressure of a fly on a banana, which you can ignore. And if they give you the speel that the debt is still due despite the fact they can't produce the CCA demand, you can safely ignore it.

    I helped a friend with a similar CCA request about a year ago on a debt of almost £4k, which after all the letters about the debt still being owed, etc, etc, he received a letter from the bank writing off the whole amount. He keeps it in his safe, just in case he ever needs it.
