Help! My uncle has received what appears to be a County Court Claim form from the notorious MIL Collections it dates to a supposed parking offence committed 2 years ago
The total amount claimed is £175 which includes £25 court fee Can anyone tell me what his options are? should he defend or just pay it?
The claim form itself looks a little dodgy but is print signed by Alan Davis - Managing Director as claimant and it mentions moneyclaim.co.uk
Any ideas?

if its a court letter from northampton then it is genuine, but you can check with the court
post #1 of the NEWBIES sticky thread has information on dealing with court claims
and there are dozens of threads on here and on pepipoo forums about this sc@m , which needs to be fought and can easily be won if you follow the same tack as all the others that have gone before you
put MIL into the forum search box to see loads of examples, especially where HO87 has helped them to win
plus parking pranksster blogged about this only recently, so read his blogs too

This is the most beatable type of court claim and is highly unlikely to end up in a hearing, even less likely to cost a single penny. HO87 is the expert on these cases so read a loads of MIL threads and read what HO87 advises people to do as regards defences.
Do not reply to any private message - except of course from HO87 if you decide to discuss it that way.
A poster with less than 1000 posts on here is not a regular so do not reply if some else (a relative newbie poster) offers to 'help'...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'll post this advice here rather than in a Personal Message so that others can read it.
It seems that we are into what is probably the fourth flurry of cases that MIL have issued this year. They can be beaten in fact no defence that has been compiled with assistance from here (or via Pepipoo.com) has failed to date.
If your uncle chooses to defend this then he should resign himself to the fact that the matter will culminate in a day in court but he will be guided and assisted all the way. If he feels that he can't face that then no one here is going to criticise him in any way should he elect to pay up. Fighting these things is not for everyone.
To complicate his decision-making currently MIL have been discontinuing numerous cases after a full defence is submitted (usually at a point 3-4 months down the line). I have lost count of the number of Notices of Discontinuance I have seen in recent weeks.
I would suggest that to buy you and your uncle time in which to research things at a little more leisure that he goes online as soon as possible using the username and password supplied in the box to the centre right of the front page of the Claim Form. He will need to set himself up with a Government Gateway ID first but that is a straightforward process.
Once he then logs on to Money Claim Online (known as MCOL) then he should acknowledge service of the documents; then select to defend the matter in full but do not submit a defence at that time - elect to do so later. By going through this log on he will effectively get an extra 14 days (on top of the 14 days that comes with the documents) in which to respond.
There is plenty of reading both here and on Pepipoo search for "MIL Collections" and you should have a welter of reading.
There are very specific ways to defend MIL cases that differ substantially from normal private parking matters although they necessarily include many of the same arguments there are important aspects that do not otherwise apply.
