Civil Enforcement Ltd - LBA

Hi, this is my first encounter with any parking ticket therefore my knowledge is still lacking even after research. my car was at kfc 10 mins after its closing time for 20 minutes and almost a month later I received a PCN from Civil enforcement Ltd wanting £60 as I am the registered keeper. It seems I followed outdated advice as I was told to ignore it and didn't even do a POPLA appeal and now I have recieved a letter before action and I do not know which step to take next. I have not contacted the company as I have been told not to and that they are an awful company to deal with and i also have not asked within KFC but i shall soon as their reasoning for the parking enforcement is stupid. The charge has now rised to £140 and I am not paying it as it is silly. I have read that under POFA 2012 they are required to hand me the PCN 14 days after the incident in which they didn't, in simple terms can I use this to defend my case and should I email civil enforcement before the date in which they claim to start court preceedings these points to make them back off? I've been told they never actually show up in court but knowing my luck, any advice would be greatly appreciated as I have only a few days to sort this.

    Yes, you should respond quickly to the LBA (by email AND by post with free certificate of posting) and you can use the point above - quote paragraph 9 of Schedule 4 of the POFA - as long as the driver is never identified.

    So EDIT your first post on this public forum, for starters! Think about what you put about who 'parked' and whether you want that to be used if they try court. This is one of the easiest ones to defend, potentially, because CEL are pretty useless at these claims recently (they haven't proceeded in many cases, when robustly defended). And as they can't hold a keeper liable, they are stuffed by a keeper defendant who resolutely says the driver hasn't been identified (and it's not your job to assist to recall who parked the car that day).
