Success v Bank Credit Card

Hello,
I just wanted to let people know about my recent experience with Bank of Scotland Credit card, just incase anyone else is in this situation.
I had entered into a Debt Management Plan and was making monthly repayments. When I entered into the plan I owed BOS £13.5K. I have always suspected that some of their T&Cs were unfair and I eventually put in a Data Access Request that cost me £10, but gave me access to all of the statements and letters they had sent me since the account was opened.
In summary, I stopped spending on the account in 2008 and by the time I entered into the DMP I had paid back only £1300 because of the interest rate on the account. When I looked at the statements it was clear that in some months the closing balance on the account was higher than the opening balance because of the interest charged.
I complained to BOS, highlighting the months, and citing that they had not given me the opportunity to repay the debt in a reasonable time, and the result is that they have reduced my debt by £6k. Additionally they have said that as I will now clear the debt in the next 12 months they are not going to issue a default notice on the account.
If anyone wants more details - because I am really keen that anyone else in the horrific situation I was in can be helped - let me know. I know everyone's situation is different but I honestly believe you have nothing to lose by challenging!

I do think that at some point over the years this has happened to us, I don't know when or with which cards but it is ringing bells with me.
I don't feel strong enough at the moment to look into anything like you did but maybe in a few months, who knows.

Was the account even enforceable? That could be why they have been so accommodating with refund of charges and default.DFW Nerd No. 1484 LBM 07/01/15 Debt was £95k :eek: Now debt free and happy :j0
