Debt letter advice

Hi all,

Years ago I had a lot of debts build up and I had 3 ccjs. I was paying these for a few years. I was then set to move house so I informed them all of my new address and was still paying and letters I was sent were to my new address. I then had lots of letters from companies saying that they had now taken over the debt (purchased the debt) and that I was to pay them instead. I had so many of these letters in a short period that I decided to stop payments and then the right one would write to me to say i'd stopped. I did this to know who to pay. I heard nothing at all. In fact I heard nothing for over 7 years! I decided to then check my credit file and saw it was totally clear of anything regarding ccjs or arrears etc. In fact it was a very good score! Anyway, to cut a long story short I no longer had any paper work regarding loans or ccjs etc as I say, it was over 7 years or more since i'd heard a peep from these people! As my credit rating was great and my girlfriend had been left a lot of money from a parent passing, we decided to buy a house, needing just a 30k mortgage. We have been in this new house for 4years now and when we moved all our mail was to be forwarded to where we are now.

Today out of the blue I have received this letter:

What puzzled me is its now been almost 10years since hearing anything (remember they knew my last address and had been writing to me there and then nothing for over 7years).
Also there is no 'amount' anywhere in the letter.

Any help or advice?? I've read somewhere on here that i can't be chased for anything after 6years of no contact??

I no longer have any paperwork regarding my past at all as it was so many years ago now.

Help?!

    County court judgments

    Once a creditor has a county court judgment (CCJ) for a debt, the Limitation Act does not put any time limits on how long they have to enforce that judgment.


    If your CCJ is more than six years old, and the creditor wants to use enforcement action, they must first get permission of the court. Special rules apply if they apply for a third party debt order or you already have a charging order. Contact us for advice.

    Hi, first job is to check whether you do have a ccj. I think the body that looks after these is tbe registry trust online and you should be able to check - do check you are usibg an official site and nip a copy cat/ rip off sute that charges you over the top. I'd suggest you Get hold of copies of your credit report from all 3 credit agencies as well just to see what's on there.
    If there is a ccj ( which the solicitors are claiming) then generally creditors have 6 years to enforce it, unless, I believe they have exceptional reasons. I can't believe waiting this long to enforce it would be reasonable at all.
    Legal beagles website is meant to be good and might be able to assist with the paperwork and how to object to the attachment.
    Stepchange or national debtline might also be of help but not necessarily be as hot on what cort application you need to make/ what firm to fill in/ what the wording of your defence should be etc.

    Registry Trust only hold records for 6 years

    Assuming there was a ccj in 2006 and no 'exceptional circumstances' why it was not enforced before 2012, I think National Debtline would be able to help - see this post

    but it would be a good idea to ask on legalbeagles too

    Hi,
    Thanks for the replies. I have been onto the Registry Trust online and have searched all their court records for each of my addresses and there are no records held anymore of any CCJs or other court orders etc.

    What now then??

    Is this company just sending a standard letter out in the hope I pay 'something' to them?? Still seems very strange how there is no 'amount owed' in the letter!

    I think you should take it at face value and respond to say you will object to any application for enforcement (don't even hint that you might be employed or give them any information they don't already have.

    As before, legalbeagles or ND should be able to help with the wording.
