Jacobs Bailiffs Help

Hi All, I have received a notice of removal of goods within 24 hours or payment of £708.25 which i do not have.

The backround of the story is that i never received a council tax bill for last year and thought it was included in my housing benefit claim.. it wasnt. In Feb i received a letter from Jacobs stating i had a liabilty order and had to pay (incidently i never received anythng from the council at all) i rang them and set up a payment arrangment which i have paid every month. In May my mum was critically ill and the payment was 8 days late but still paid. Today i came home to the notice and i an devastated!!

I have spoken to the Agent and to the office who were jyst obnoxious toward me and wouldnt hear a bar of me carrying on with my £120 per month. There was only £398.25 left to pay abd now they are saying its £708.25.

Does anyone have any advice about what i should do, I am fully prepared to pay it back as per the arrangement i just cant do it in one go. They are having none of it. Ive locked the doors and my car is under finance.. do i just sit it out and carry on paying the 120 per month or should i try to reason with them.

They were truly awful to me!!

    With regards to the Demand Notice - what about the Reminders (at least one) and Summons that would be issued prior to a Liability Order being granted ? They would have been posted to an address - have you checked with the council which address ?

    Assuming they were posted to the last known address the council held and they weren't returned un-delivered then the documents were served correctly.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Not received anything until the first letter from jacobs otherwise i would have paid the council and avoided the fees :-) im not trying to avoid paying at all i just want to pay at a rate i can afford. The debt is owed and i have being paying it back i just dont understand why they wont carry on the payment plan considering there have been no missed payments at all. The figure on the notice i got today also appears to be incorrect. The initial amount was for 1000.55 ive made 720 worth of payments which would make 455.55 remaining (including the 75 admin fee) even with a 235 enf fee added on (which shouldnt be included until 7 days after this letter) the amount would still only be 690.55.

    The agent i spoke to just wouldnt answer my questions or engage with me past the phrase payment in full.

    Once it's got to an enforcement agent they are not required to accept any payment arrangement, other than full payment.

    You can still challenge the original notices if you think they were sent out wrongly - a defect in any of them would invalidate the liability order and thus the enforcement agent action.

    The enforcement agent should give you a breakdown of the balance and payments on request - if not, call the council and their recovery officers will have access to Jacobs' system. Jacobs have a good system that will give the council the figures straight away.
