Removing his name

I apologise in advance for the waffle.

When I divorced my husband the court order stated he was to remove his name from the title deeds and that I would pay the mortgage alone. This was all agreed and the mortgage company said once I had paid my debt and paid regularly for 2 years they could remove his name.
7 years later he still hasn't removed his name from the deeds so my new husband and I seemed our solicitors advice and asked them to remove his name from the deeds (we would pay for it all) but the mortgage company are now saying it is not in there policy right now to remove his name off the mortgage or allow his name to come off the title deeds.

Anyone have any ideas as to where I turn next? The thought of something happening to me and him getting his hands back on my house scares me

    usually the name on the deeds and the name on the mortgage match.
    have you investigated a mortgage excluding him, either in your own name or with your husband? Things have changed over the years with affordability calculations etc and the mortgage company will need to be happy that you can service the mortgage in your own right before removing any names which may involve going through a full application
  • I would suggest speaking with a mortgage broker. They'll be able to assess if you afford to take the mortgage over based upon lenders affordability criteria.

    Once processed this will then have the involvement of a solicitor who will ensure the transaction is accurately and appropriately concluded.
