Hi guys sorry if posted in wrong bit - after a bit of advice, my son has been a bit of an a-hole and we don't see that much of him. He owes court fines and recently we had a visit from Marstons at our address - I gave them short shrift as he doesn't live with us and I have no idea where he is living. We do have contact with his ex partner and our granddaughter who we love dearly.
Marstons "lady" then paid his ex a visit at where he used to live and basically used the softly softly approach to gain entry ("just let me come in and talk love") she then threatened the usual "van on its way" seizing goods etc. even though he doesn't live there and nothing in the house is his. His ex is only young and was terrified she had her driving test booked in half an hour and rang my wife as I was working miles away, my wife then paid Marstons £800 (4 unpaid £80 fines plus their "costs") on her card (I know!) as she couldn't get hold of me.
All I want to know is what can his ex do to stop this re-occurring ie how does she prove to these people he doesn't live there? She rents the house from her own mother. I have a feeling there are more of these fines he hasn't paid so they will be back. We can't afford to pay any more of his debts and I don't want these sharks mythering her; a single parent who is doing her best.

Hi Paulsad,
This is always a very difficult situation. The bailiffs will visit any property where it is reasonable for them to believe the liable person (and/or their belongings) are. If she is visited in the future then tell her not to let the bailiffs in, keep the doors locked and make sure she can prove anything outside her home (like a car) is hers or hidden - just in case.
She can complain to the bailiff firm now (and if this happens in the future) and make it clear that the liable person doesn't live there and ask them to leave her alone. She can also complain now about the bailiffs threatening conduct and make it clear he isn't at that address now and if they do receive any future debts for him then don't bother her. She can use documents like the electoral role and council tax bills to try and demonstrate this.
If they refuse to accept this then escalate the matter to CIVEA (their trade association) and the court manager. At the very least, this will establish a history of the problem. Do everything recorded delivery and keep copies. Good luck,
