TFL fine for not showing valid ticket for public transport

Hi,

I got a letter from TFL requesting "parent/ guardian" pay £40 for child under 16 "unable to provide valid oyster" and was issued with an on the spot fine

The issue is, the child in question was awaiting "renewal" and there was delay after delay on TFL's part (citing lost post) which took up 2 months

Hence in this time- child in question would inform bus driver they were under 16yrs old and bus driver would let them board without having to swipe (since no valid oyster)

This was explained in an appeal letter but just had a reply from TFL citing that it is "11-15 yr olds can travel free but it's the responsibility of the individual to ensure they are able to produce a valid oyster photo ID"

And the fine remains.

Are there any grounds for further appeal?

    It's a Penalty Fare; it's not reached a serious enough stage to be a fine.

    Buses are not free to Under 16s if they do not hold, and show, a TfL pass, so the Penalty Fare is correct and needs to be paid.

    As Yorkie has said, there's no grounds for appeal. However, if you failed to pay this I'd like to see what action they would intend to take. Although your child is legally accountable at their age, TfL would likely NOT pursue the matter as it wouldn't be in the public interest to go through the courts. Having said that, for the sake of this relatively small penalty, is it worth the letters chasing you for money?
