Lowells Mobile Phone Stat Barred

Hi Everyone,

I have Lowells putting default payments on my credit file, I've been searching the net for a few hours and have not found the info I need.

Some peoples accounts that I have read are just updated from, 3 mobile for example when they buy the debt. My account has not Lowlife have made it themselves and added it.it was neve on there before. I believe the account is stat barred but how do I go about asking them to prove the dates when mobile contracts are not under the CCA.

I think this debt is over 6 years close to 7 years and they have just fiddled the date so they can try and get money from me and I have no way to question it with the CCA?

The debt is not a massive amount and my credit file was clean and I never really had credit before and now I need it this is screwing me up.

If someone could give me some advise please, would it be best to pay this off in 1 go, would that put my credit back up to normal or should I say get lost and just wait until it drops off? If I pay it off how much will it help my credit rating ? And I'm not sure when it would drop off if I leave it.

The first red D has DF under it and all the others just have D with no data avaliable

    Hi,


    Two choices.


    (1) Send Lowell the standard "provit" letter, however that may not produce any more information than you have now.


    (2) Send a SAR (subject access request) to three mobile first, that should get you the original date of default, then send a statute barred letter to Lowell enclosing proof of the original default/last payment date.


    A SAR costs £10, but should get you the information you need to put Lowell to bed, assuming your dates are 100% correct that is.

    Hi sourcrates,

    thanks for that information, I'm sure the debt is Stat Barred. When it says the Date of default 11/05/2013 does that mean that was the last time they have had a payment ? and Account start date 28/04/2012 mean this is when the mobile phone contract started from ? If thats the case 100% they have fiddled the dates and if they have is that normal for these types of vermin to do these things ?

    If I can prove it's stat barred will they remove the default payments and debt from my CF and even if it's not stat barred say a few months out of 6 years, would they update the account to the correct dates and therefore meaning it would drop off my CF when it hits the 6 years.

    The default date is not necessarily the last time a payment was made, infact its likely you will of stopped paying 3-6 months before this.


    Can you remember when the last payment was made ?


    Unfortunately even if your debt proves to be statute barred, all that means is the creditor is unable to retrieve what its owed through the courts, all other default information will still be valid.


    However, if the default date is incorrect, then you can complain and have that rectified.
