Restons - Charging Order help!

I have been paying Restons £25 a month towards a credit card debt of about £5,000, they asked for an I & E form which I completed and I increased my payment offer to £30. They have rejected this and have sent a letter saying they are applying for a Charging Order on my property which is in joint names, the debt is just in my name. I only communicate with them in writing and wondered what my next step should be? Thanks

    Do Restons already have a county court judgement (CCJ) for this debt?

    They would need a CCJ before they could apply for a charging order. If they already have a CCJ they have the right to apply for a charging order, you can’t really stop that. If they don’t have a CCJ already they can make a claim against you.

    The key thing is to pay the monthly amount the court sets, rather than what Restons want.

    In your case it would technically be a restriction against your beneficial interest in the property, rather than a charging order, as it’s your sole name debt on a jointly owned property.
