PPI and CCJ loan help!!!

Hi everyone, just wanted a bit of help if possible...
I got a loan with co-op around 10 years ago for a business venture and was what is apparent now 'mis-sold' ppi which I didn't need as was self employed. I paid the loan monthly yet around 6-8 years ago (not sure) I requested my ppi back through all the proper channels and was basically ignored, so I sent letters to say if it wasn't resolved I would cease all payments until it was sorted and would have been happy just to have this ppi amount deducted from what was owed. I stopped paying and eventually debt went to dca who've been chasing me ever since. I notified them the same, I would start to sort out once my ppi was aknowledged yet they said they weren't responsible and to get back on to co-op who in turn said it wasn't in their hands anymore... Basically I had a bit of contact still with dca up until last year and couldn't be bothered banging my head against the wall anymore so stopped all contact. They issued me with a ccj and I've had that for around a year and I've buried my head in the sand with it all... I found it all depressing and unfair at times and now they're saying they will instruct bailiffs to enforce it, not sure what to do if any of you good knowledgable people can help??? X

It's a bit late now.
They've got 6 years to enforce the CCJ during which time you have several options and one of them is to keep your head stuck in the sand. If they aren't getting any response from you it's unlikely they'll do much more.
If you own a property you need to take action as they will one day check that and put a charge against your property.
If they do get a charge against your property you do not need to make any payment. They'll get the money when you sell the house.
If you own a car the bailiffs that visit can take the car away so it might be a good idea to sort it out.:footie:Regular savers earn 6% interest (HSBC, First Direct, M&S)
Loans cost 2.9% per year (Nationwide) = FREE money.

You stopped paying it so they don't owe you anything. The best you can hope for is it goes some way towards repaying the debt, the interest and the fees which has been proven in a court that you owe.
You would need to consider taking them to court to reclaim the PPI. That will not remove the CCJ they have against you.:footie:Regular savers earn 6% interest (HSBC, First Direct, M&S)

Unfortunately as a consequence you were in breach of contract. So legally the lender was in the right. No ifs or buts.0 -

Thanks for the reply, so they won't do anything unless I aknowledge them? I don't own anything on paper, bank account is in limited company just a van not worth a lot in my name, suppose I should sell that to company? I wanted to sort it but they tried to ignore me and fob me off first when I needed it sorting, seems I've got the s****y end of the stick from them trying to play dodgeball0 -
Is the ccj set in stone now or could I appeal to get it set aside? I'll gladly pay the remaining balance without the ppi but don't see why I should pay it all... If I agreed a full and final with dca could I have the ccj removed either by them or set aside if I've got some kind of case to take to the court?0

If you settle it then it will still be there for 6 years from the court date.
You can try for a set aside but they can start the process again. To do that you can't acknowledge the debt by paying it. That's also very costly.:footie:Regular savers earn 6% interest (HSBC, First Direct, M&S)

You complain against the Co-Op - there's no time limit0 -
You don't claim PPI, there is no right to have it back.
What you do is complain that it was missold. To be missold either you had to have no need of it, or it would hnot have paid out in your circumstances, or a good reason with loans was single premium.
When you complain about it now the likliehood now that you owe them mooney because you defaulted on your loan, is that any redress will go to paying off what you owe.
Fill in the form here and send it to the co-op as the are the sellers [it doesn't matter if the DCA have it now],They have 8 weeks to respond, if they refuse yor complaint, you can go to the FOS afterwards.

You already have the loan account number.
Your chances of going to court about PPI and winning are practically zero because it's not a legal matter, so followthecorrect complaints procedure.Non me fac calcitrare tuum culi0
