Unfair ccj on personal loan

Hi everyone, just wanted a bit of help if possible...
I got a loan with co-op around 10 years ago for a business venture and was what is apparent now 'mis-sold' ppi which I didn't need as was self employed. I paid the loan monthly yet around 6-8 years ago (not sure) I requested my ppi back through all the proper channels and was basically ignored, so I sent letters to say if it wasn't resolved I would cease all payments until it was sorted and would have been happy just to have this ppi amount deducted from what was owed. I stopped paying and eventually debt went to dca who've been chasing me ever since. I notified them the same, I would start to sort out once my ppi was aknowledged yet they said they weren't responsible and to get back on to co-op who in turn said it wasn't in their hands anymore... Basically I had a bit of contact still with dca up until last year and couldn't be bothered banging my head against the wall anymore so stopped all contact. They issued me with a ccj and I've had that for around a year and I've buried my head in the sand with it all... I found it all depressing and unfair at times and now they're saying they will instruct bailiffs to enforce it, not sure what to do if any of you good knowledgable people can help??? X

    Thanks for the reply, so they won't do anything unless I aknowledge them? I don't own anything on paper, bank account is in limited company just a van not worth a lot in my name, suppose I should sell that to company? I wanted to sort it but they tried to ignore me and fob me off first when I needed it sorting, seems I've got the s****y end of the stick from them trying to play dodgeball

    CCJ suggests they have put the case in front of a judge who has sided with the lender.
    Sorry but if you stop paying for the loan you cannot cry its unfair now whatever the reason.

    Say's you. You had no right to stop the paying the loan because you thought it was unfair. There are procedures and appeals you could have followed at the time but you took the wrong way out and are now paying for it. There is nothing you can do except let it now play out, if you have nothing that's what they will get. depending on the amount bankruptcy may be next.

    If I remember correctly you have six years to file an appeal for mis-sold PPI.

    Beyond six years there's nothing you can do.

    So who's ultimately responsible for the ppi now?
    From what I understand the banks were getting swamped by hundreds of thousands of PPi claims due to the amount of companies chasing it on clients behalf. This led to a mass rejection letters because they just simply couldn't cope with demand leaving them with just the ones who shout the loudest to deal with.


    Companies were shouting louder than you and then you just buried your head in the sand and let it go, clearly taking the wrong way out and as said above it's now to late.

    Your title needs amending, there is nothing unfair about this CCJ. You stopped payin gyour loan then stopped dealing with the DCA. Their response, obtaining a CCJ could hardly be described as unfair.

    You need to deal with the two issues seperately. Look into the PPI. Look to resolve the CCJ

    The terms and conditions of your loan agreement would not have allowed you to stop payments because of a PPI claim. Perhaps your thinking was that this would force them into dealing with the issue but, as you have discovered, this is not the case and ceasing payments was unwise - as was ignoring the issue later one.

    You really need to deal with the CCJ.
