    Frankly, if it was me, I would try to find a compromise. I would do everything to try to come back asap, even if an extra week would have been nice and if the holiday coincide with the surgery (ie. shortly before or after), I would try to see if it is possible to move it to a later date). Ultimately, it's about showing his boss that he is doing is best so that his absence doesn't have a negative impact on the company rather than taking a 'it's not my problem/fault, so tough attitude'.

    The surgery was originally in for the end of the month, consultant has deemed it serious enough to warrant bringing it forward to next week and our holiday isn't until the end of August. He said to his boss he would happily wait until a later date (end of the month or next month even) but there's, apparently, no good time for him to go off. His boss seems to be the one unwilling to find a compromise.

    For the surgery or for the holiday. As it stands, it would mean that he could be off for 6 weeks and when he is suddenly better, off on holiday, so potentially off for two months.

    Could the holiday be moved? If he really wants to keep this job, he should indeed discuss it all with his manager, ie. when is the worse time to take off, agree how he will keep in touch on a weekly basis so he gives an idea of how soon after surgery he is able to go back, offer to postpone holiday, or bring it forward if this is posssible, ie. could you go from week 4 to 6 after surgery so that he is well enough to go on holiday, but giving him a bit more time to recover fully before going back to work.

    Does his illness amount to a disability for employment law purposes? For example any form of cancer is automatically a disability.

    If it does then the employer is obliged to make "reasonable adjustments". Also it would be unlawful for them to discriminate against him because of his disability. In such circumstances, should he be dismissed, then he might be able to bring an unfair dismissal claim despite not having two years service.

    I am struggling to see how someone facing the choice of life-saving surgery or losing their job is a subject of amusement for you. Perhaps you could enlighten us all as to what is so funny?
