    A very interesting piece from Frances Coppola.A couple of points from me

    As she says ,Judicial Review in the Uk cannot extend to primary legislation ( as Parliament is sovereign).Which would suggest a case to the ECJ or ECHR

    Maladministration - even the best possible outcome from a Waspi point of view cannot result in restoration of the"lost" pension.There may be some individual cases where DWP has provided incorrect information,but generically the ombudsman would need to rule that the DWP was directly liable for demonstrable and evidenced losses through it's actions.In my view this would be next to impossible for any claimant to prove.Hearsay would not be acceptable.

    More likely is that the optimal Waspi outcome from a successful maladministration complaint would be a consolation payment ,which is ex gratia with no admission of liability.This can start as low as £25 but could be as much as £500.

    Finally,once a topic is sub judice as defined by Parliamentary rules ( the Waspi situation is not there yet) then the subject cannot be raised or debated in either house ( Commons and Lords)nor in Select Committee

  • I am disgusted that some people agree with the rise in age .I've worked from 15 was looking forward to my retirement to have a life before I turn my toes up.But they couldn't just put it up once oh no twice mine has been put it its ridiculous .these poor kids coming hope haven't a dog in hells chance of a job because us codgers are taking um all up so let them turn out no good to man nor beast and get into trouble because they've no future or self respect lounging about all day with. Too!!! Much time on their hands .I am sure they want us to pop our clogs so they won't have pay us because us whom have worked all our lives sit here and take everything thrown at us .Take a hint government no one wants to employ us we've worked dam hard for this country .STOP !!!!!!! Kicking us in the teeth and let us retire when we should have use your brains and think we take up the jobs young ones should be having to give them some self respect and a purpose in life .wake up and smell the coffee:mad:
  • And how many more lies my pension age has gone up twice are they gonna give me compensation for that instead after always working I'm broke can't get a job and not able to eat half the time is that how you reward people who have worked their socks off for this country .you need to try having to live like this it would put your feet on the ground and make you realise just what you've done your actually killing people .can't afford to eat put heating on ect ect so you'll get your we will all pop off and all that.money.people have paid to this country .ENJOY you will be warm and have a full stomach:mad:

    and you still can.
    An extra 1-18 months is not the end of the world.

    Of course they aren't. You don't deserve it. You have no basic right to have a state pension paid to you for longer than anyone else born on the same day. All you are is unhappy that a bit of discrimination that you benefit from is being reduced.

    Might make a good film though.

    FTR - I am a woman. A woman who has also had her state pension age put back twice.
    But I'm a woman who can see the bigger picture.

    I worked my socks off for this country and now have a decent pension provision.

    Just curious, after 40/50 year's hard work, what happened to all your money?

    Presumably it's still in the 'system' until Sue133 reaches her revised state pension age.

    As mine is until mid 2018.

    Luckily, I have an occupational pension that bridges the gap between my own choice of retirement age (it was 50) and the date I get my state pension.
    I wonder if Sue133 has a personal pension?
    And if not - why not?

    Polly, its not lucky. It is part of the financial planning you did. It may have been an easy decision for you but you still had to agree to be in the scheme. You could easily have opted out and kept the contribution to spend on holidays in Spain and leave yourself bitter and poor in retirement.
