Council tax band being changed back!

In 2006 we moved into our current home. Within the first 6 months we submitted an appeal against our council tax band and after our case was considered the VOA wrote to us in early 2007 to say that they agreed that our council tax band was incorrect and we were rebanded from a Band E to a Band D.


Last month we had an email from VOA to say that they thought our council tax band was wrong. I replied and explained we'd already had it moved nearly 10 years earlier and that we were confused that they were reviewing our band based on April 1991 prices in our area, when the identical exercise using the same data had already been completed by their office.


On Saturday however, we had a letter from them saying that they now thought the original change was wrong and we have been told that we are a Band E again with immediate effect.


Has this happened to anyone else? We're a bit speechless and wondering what to do next...!

    Appeal...you might have to dig out everything you used in the first place to appeal with and resubmit it with additional information to prove why you think the property should be Band D.

  • Thanks for your reply. I didn't keep the original information, only the letter in 2007 confirming the change from E to D as I didn't expect this to happen.


    I could repeat the exercise (like I don't have enough to do!). The tone of the letter was pretty unpleasant to be honest, I feel a bit like it's being suggested I tried to 'con' them in the first place! :-(

    The problem is that the VOA have a legal duty to ensure the council tax band is correct and to correct it if they it's wrong (for any reason). It's certainly worth appealing the decision though, it certainly can't do any harm to do so.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    The VOA don't usually increase a band which had been previously reduced without a very good reason. This reversal would have been researched very thoroughly and there should be good evidence to back up this decision.

    It is not a common occurrence but it does happen.
