bankruptcy annullment

hi all, ok i got forced bankrupt for an old debt of 4000 as said in my previous posts, anyway last month i successfully got my bankruptcy annulled by the judge on an "ought not to be", the judge gave me till 21 of august to pay the petitioners debt with a remortgage which was nearly complete. The follow up court date is monday 10 sep and the solicitor ha stold me that the funds ae arriving on monday afternoon so obviuosly i am in court at 10 am so it will be to late.

He has told me to go to court and get it adjourned till the next available date and the money will definately have been paid as they will be paid monday afyternoon by bank transfer. The solicitor will fax all the details to the court on monday morning before i am due in, my question is will he just adjourn it or will he say im bankrupt again because i missed the deadline, i am a bit worried. ty

by the way the petitioners debt has been informed and they are fine about it.

  • Has your solicitor given you something in writing to confirm when the money will arrive? If not, I would ring or fax something to him today or tomorrow asking for something in writing to take to court. Your solicitor may well fax the documents over on Monday morning, but it's a bit close time-wise - by the time the faxed paperwork gets to the right person, your hearing may have been over with, so you'd be better off having documents in your hands to take with you. With paperwork to back you up, I would have thought the case would be adjourned - it would only need to be adjourned for a couple of days at most, & it would churlish of them not to agree to it since the money will be there only a matter of hours later, on the same day as your hearing. Can your solicitor not come to the hearing with you? The request for adjournment would sound better coming from him. :)

    sorry i think u misunderstood , which will be my crappy english lol.

    My solicitor who is dealing with my remortgage has wrote a letter explaining when i am getting the money and the situation and he is going to fax it monday morning to the court before the hearing so the judge can see it.

    Make sure the fax makes it onto the court file in time for the hearing. The files will already be with the judge (they go up the day before or Friday in this case) so it may be worth phoning the court as soon as the fax is sent to ensure it goes on the file.
