Having notice period cut short without warning - what are my rights?

    IF the notice was in writing then the OP should counter the current situation with a request for clarification denying that they mutually agreed to an early termination.


    Given they have no proper notification they should turn up for work as normal to avoid any well you stopped turning up so we are not paying you.

    I should add that I still have a company credit card and key to the clinic which I'll obviously return asap. due to my emails having been cut off I have no access to either my termination notice (in which I confimed my 4 weeks notice and last day as 16/06) nor any of the acknowledgement or even my employment contract (clearly a case of I didn't expect this and a valuable lesson learned).

    My main aim is to ensure that I get paid for my notice period plus any expenses I haven't submitted yet rather than causing any stir above and beyond this.. I'm obviously aggrieved by the way the situation was ultimately handled yet overall I do know that the email caused a lot more embarrassment and a knock to staff morale for him than for me.

    I'll be sending an email to HR today and hopefully they will confirm full pay to the end of my notice period.

    Thanks again for all the help and advise and I'll be back as soon as I hear.

    Seen it happen, and it happened to me, I resigned giving 3 months notice, within an hour of resigning I was on gardening leave which was great as it meant I could bring my starting date of job 2 forward and get double bubble for 3 months.
  • I imagine they intend to pay you, but don't want you in the office. But if you had a text message from HR asking you "when would be a good time to talk", why wouldn't you call them straight back to clarify? I just can't understand why anyone wouldn't do this.

    As far as saying it was agreed goes, surely it's better for him to say that to the company than to say "We don't trust him to work the last 2 weeks conscientiously".

    OP got the text message to call HR the day after the email was sent to all staff and her email was disconnected. Why wouldn't she try to clarify her rights before being bounced into making such a call? Only a fool would respond to such a message completely unprepared!

    Only a fool is incapable of obtaining information from the other party without committing themselves to anything. There's 99% certainty they would say straight away that they are going to pay the full notice, whereupon nothing else matters.
