Small claims help needed please

Hi i made a claim against one of my window cleaning customers that had a outstanding bill over a long period of time. The amount was £21 (Was about the principle) I have just had a response from them and they have paid the £21 into my bank account, Should my £25 fee also be included? Thanks in advance

    How much did you put on the claim form?


    Did they admit the claim & pay or have they just received the papers, paid £21 to you and then "defended" by telling the court they've already paid it?

    Did you sue for the court costs in your filing? If you didn't then the case is settled, although the form by default asks to add the court costs as part of your petition.

    If you did then fill in your return accordingly, that while 21 was paid, you still want a judgement for the court costs. Better yet just give the defendant a call and explain that if they will also fork over the 25 quid then the case will be settled in full and done with. If they will refuse, continue with the claim as before, as they will also be responsible for all future costs that may come.

    And for the future you could have also tacked on the interest with your claim calculated from the day money was owed.

    yes they should also pay the court fee.
    Just a single mum, working full time, bit of a nutcase, but mostly sensible, wanting to be Mortgage free by 2035 or less!

    If you have a judgement against them they have not satisfied that judgement until the full balance is paid.

    If it is merely an ongoing claim, you can get the courts to amend the balance owed, deducting £21.
