Proof of debt

I had a letter saying I owed £4,500 for an Abbey National debt.

I sent a letter saying I have never had an abbey national account or loan could they send proof.
I also said "I look forward to hearing from you within 12 working days".

Well those 12 days have come and gone and I've not received any proof I owe it ( nearly 2 weeks past the deadline)

What can I do now?

  • You need to wait for a reply from them.

    It can take these DCA's many weeks to get around to replying. And if they start to telephone you, explain that you are dealing with the matter in writing and will not talk to them on the phone.

    Hi there,


    This will probably depend on whether you sent a CCA request or a "prove it" letter. If it was a CCA request then the creditor has 12 working days to supply a true copy of the original contract and breakdown of the account and failure to supply this information could mean the debt is unenforceable until they do.


    However, if you just sent a "prove it" letter then the 12 day deadline you gave them is not binding. There isn't much for you to do at this stage, just wait and see if they come back to you. If they do, and cannot prove the debt is yours, but keep asking you for the money you should make a formal complaint on the grounds of harassment under the FCA guidelines.


    If they prove it is yours then you would probably need more advice about negotiations and debt options. Good luck,
