Ok, whats my next step now?
I've had a letter from Robinson ways solicitors informing me that they are going to go and apply for a ccj.
I have had no contact with them or any of the other agencies that had the debt.
The last payment made on this credit card would have been at the latest Feb 2011.
I/we have buried our heads and ignored all letters from them.
I looked on stepchange about doing a dmp for this and the other 3 cc. That are all unpaid.
But they say that they will take my sons DLA into account, is this right? that money is for him to help with his needs.
Anyway I'm rambling now, the question is what do I do about the ccj.

Hi Jim-Jim,
You have a few choices when replying to claim forms - you can complete the Admission form (accept the debt) and complete the income and expenditure and make a monthly offer to repay (assuming you can't pay it in full). Or you can complete the Defence and Counterclaim form (and dispute the debt). If you do this you will need some legal advice. I appreciate the last payment may have been 2011 but that would be within the last 6 years so the Limitations Act wouldn't apply.
You must complete the relevant forms within the deadline, which is 14days from the issue date, plus normally 5 days for postage (assuming the forms are from Northampton County Court). Send your reply recorded delivery to the address specified on the Particulars of Claim. We have a factsheet about this that may help you, available here.
With regard to the rest of your debts it is difficult to say what the best solution is, we would probably need a bit more detail, such as how much you owe? With a DMP they will normally take all income into consideration but when you detail you expenses you will just explain what the DLA is spent on and it should then be accounted for in the outgoings - so it won't go towards the debts. Does the letter say we will, or we may, or we could, apply to the courts for a CCJ ?
There letters are full of carefully worded veiled threats.

court fees 410.00
costs 100.00
intrest 1875.59
debt 4424.75
I've been told as oh is self employed it different how they take our money into account, but I cant get to use the phone in private yet.

Right, well that's pretty clear and would comply with the civil procedure rules.
