Lowell's default date changed

Options
Hi,
I've been trying to clear debt acrrued during my time with a financially abusive ex which he got in my name. He's long since wandered off leaving me with the debt. I have an account with Lowell's which was taken on by them in 2011 and went into default very soon afterwards although I don't have the exact date. I requested my credit record last week and Lowell's have added a default for November 2015!! Is there anything I can do to find out the exact date of the original default and ask them to reinstate it to that date? I can't see it on my credit report. Another 18 months and I'd have had a clean record and everything outstanding paid if not for this, urgh.

I intend to pay them which is one of the reasons I requested my credit report so I could check for any leftover debts I might have missed and be done with it all. Should I hold off on paying them til I get this sorted, or will the offer of payment maybe help with negotiating this?

Thanks for reading

    Hi,

If you think the default date is incorrect, you should write and complain.

You can use it as leverage when settling the account as well if you choose to.

Hi PixieDragon and welcome to MSE,

Sourcrates is right, you should write and complain to Lowell about the date of the default. Obviously it will depend on what the debt was for originally but a default is supposed to be registered between 3 and 6 months, in most cases. This is outlined in the Information Commissioners Guidelines available here.

If Lowell refuse to change the default date then you can escalate it to the Financial Ombudsman and the Information Commissioners Office. Good luck,
