Defaulted on IVA

I took out an IVA about 10 months ago and only managed to make a few months of payments as my circumstances changed unexpectedly and I had to focus on priority debts such as rent, utilities, food etc....
As things are not much better I think the only way to go now is Bankruptcy which I knowa bit about as my partner went B/C last year.
The accountant I have the IVA with has said they cannot afford to file for B/R as its more expensive for them and they havnt recieved sufficient funds.
I cant afford it either as its just money I havnt got.
Will one of my creditors apply for it? Not all creditors bothered to respond to the IVA but the biggest one that did is the Nat West and it is a considerable debt.
Can anyone advise me please?

  • Hi, really speaking you are back to the position you were in before you had an IVA. Why did you go down the IVA route ?? Seems you have no property etc. If you have no assetts, your creditors will not petition for your bankruptcy. Go back to a DMP if you had one, dont let your creditors hassle you on the phone ( dont speak to them, converse in writing only ) and try to save for your BR fee's asap
