Bank charges not paid nearly six years ago now passed to debt recovery

Hope this is in the right section of the forum so apologies if its not :)

I received a letter from Link financial, they say they bought a debt from co op bank, i closed the account with Co-op on Sept 2010, i basically got in debt with payday loans nearly 6 years ago, didn't pay the debt and because the money was not in my account, Co-op tried to charge me fees, i eventually paid the payday loan people but i didnt pay co-op, i never once got a letter from co-op to say i owed money for these fees, it did say on my credit file there was late payments for a number of years, now nearly six years later i have a letter from link financial saying i owe £94.58.

I have asked for the closing statement of the bank account, i am assuming this company link financial has put interest on the fees,

Can i be defaulted for this? should i go to the financial ombudsman to fight my corner and maybe get the amount reduced?


Any advice would be great, thanks in advance

  • Firstly, you need to check your credit file to see if it's already been defaulted. I would think it has. It cannot be defaulted a second time.

    Secondly, do not admit to Link or anyone else that you owe the money or are connected to the account in any way.

    You need to draw the matter out until six years have passed since you last made a payment or acknowledged the debt and it will then be statute barred.

    See the thing is, link have a copy of my bank statement from Co op, which they are sending me in the post, i am quite good at checking my credit file, I was not defaulted by Co op, it was put on my credit file as a late payment, il just have to keep denying it and trying to fight it until September.... But they are sending me letters out each week
