Hi all
Just curious but I am in the process of negotiating a self managed payment plan with a DCA and I'm wondering if they can force me to reveal my wifes income and request a higher payment even though the debt is solely in my name?
Also, am I legally bound to provide bank statements if they ask for them? Can they ask for them?
Thanks as usual

Legally bound ???
Your not legally bound to disclose anything to a DCA.
How exactly would they force you to disclose information do you think ?
They have no more legal power than next doors cat ferry !!!

A common mis-conception amongst the general populous is that debt collection agancies have some kind of legal power.
Nothing could be further from the truth.
Despite spewing out legal looking letters, they are nothing of the sort, they are very cleverly designed to look that way in order to make you think it's something important.
They would have to use the same legal system we can all use, should they want to take you to court, they are about as far away from a legal company as you can get.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi Ferry,
Debt collectors can ask for all sorts of information but you don't need to send any details to other than your SOA- it should be accepted at face value and there is no need to send bank statements or payslips etc.
As far as what to show on your SOA - it is up to you. Sometimes creditors will ask you for a household budget to show that you and your wife are splitting the bills fairly but you are not required to do this. If you would rather send a sole budget and only show your income and what you contribute to the bills, then that is fine too. Good luck,
Laura
