Claiming back no fault Home Insurance excess

Last November the tenants next door moved out and asked one of our kids to mow the lawn and we found this. This is outside their back door and the full wall is our Conservatory.
We asked the Tenants why they hadn't reported the leak and they said they had for five years! the LL would come and mess around for a bit then it would stop dripping for a few days......this carried on though the five years of their tenancy. At one point the LL got some wire tied it to his overflow and pulled it towards our guttering which didn't quite reach and flowed down the wall behind the down pipe.
We ended up having to get the insurance involved as the damp caused a lot of damage our side.
We had to pay extra excess as it was classed as water damage and have now been told that
"Although the LL admits he knew about the leak for a while he did not know it was damaging your property and when he did find out he sent a plumber round" (he sent a plumber round who couldn't fix it or switch the water off as the stop tap was broken)
Now I have messaged from the previous Tennant stating she had told him for over five years, log numbers from the local Council etc and they still say it's not worth taking to court!!!!
I thought this would be simple, his house damaged our house his insurance covers our damage but no......... I need help!!
Not only is my Husband on a War Pension so not loads of spare cash it's the injustice that really stick in the throat.
Rang the Ombudsman who said they can send Lloyds insurance company a letter but they can't do much unlike with car insurance.
Any suggestions?
