So, Ive been dumped by my DMA. What now??

Hi,
Thank you for reading. Its going to be a long one, so grab a cuppa!!!
Ive been in a debt management plan for 11 years now with pay plan. Things were ticking along nicely, until 2 years ago when they started to take duplicate payments from me. Although i was checking my bank statements i missed it as the two dates separated them by a page so i only saw one payment going out a month. Completely my fault for missing it, Payplan weren't very forthcoming with helpfulness and i ended up getting the bank involved who just took the money off them.

4 months later I've had an email to say they don't want to deal with me anymore as i haven't 'complied' and they 'can no longer help me in my situation'. Ive got 30 days notice. Ive emailed them to ask who the creditors are now as i only have statements from 2 as the debts been sold on so many times now. So i don't even know that let alone what the balance is now.

So, what the blinking heck do i do now?!?!! Seriously considering throwing myself under a passing bus in the hope it might make this rubbish finally go away, so any advice would be greatly received!
Thank you

You can find out everything PayPlan knows about you and who now owns your accounts:
You may request details of personal information which we hold about you under the Data Protection Act 1998. A small fee will be payable. If you would like a copy of the information held on you please write to the address provided at the bottom of this page. (See Privacy Support)
    Link

Also getting a statutory report from all the credit reference agencies (Experian, Equifax, Noddle, Clearscore) will do much the same thing.

Armed with this, talk to a different DMA, or manage it yourself.

After you do the above, CCA all relevant accounts, see if they still hold enforceable paperwork or not, seperate the wheat from the chaff.

11 years is a long time to be on a DMP, why not see if you qualify for a debt relief order ? Dependant on how much debt you have of course, and your personal circumstances.

If you don't want to self manage a DMP, there's always stepchange to fall back on.

    Hi

I agree with the other here in terms of finding out information on your debts and possibly self managing, trying a free DMP with Stepchange instead, or maybe considering insolvency to have your debts written off.

Do you know roughly how much you still owe on debts altogether and how much you can afford to pay towards them each month?

I genuinely don't know how much i owe now as i haven't seen a statement for about 5+ years.

At the start they were getting a good chunk (hence not doing an IVA), once that dropped (i was made redundant and am now on a lot less, but they've been happy enough for the past 5 years) they sold the debt on and thats where the statements and knowledge stopped as they sent it direct to pay plan and that was that.

Sorry for being dozy but what is a CCA?

Ok so it sounds like first things first the quickest thing is going to be to get a credit check to see who pops up, then i can contact them directly and get something in place for the end of 30 days? Once I know who they are and that they are getting something i can think a little clearer about long term.

Is it easy to self manage or do they start taking the pee as your on your own?
  • Oh and whats a debt relief order?
Sorry i know I'm asking silly questions
  • oh my god they've just sent an email saying they've sent it in error.
what the hell are they playing at, I've been sobbing since i got it, really short with my children and wondering what the point in life is.

Thank you for the advice, i think its about time i took it back in control.

But what is a debt relief order and a CCA?

Over the next few months we are carrying out an exercise with those clients who are either making nominal payments or whose expected repayment term is very long. The purpose of the exercise is to ensure that your current arrangement is suitable for you and, if not, to suggest another alternative.

Please continue to make your payments in the normal way. Within the next few weeks you will receive another communication providing details of a member of PayPlan staff who you can contact to discuss your situation.

We are very sorry for any concerns that our first e-mail raised. PayPlan’s first concern is now and always will be for our clients.[/FONT]

Good to hear from the Payplan rep. You don't really post here enough, you know?

Can you confirm that your clients do not need to pay a fee to find out how much they owe to who, and what the reference numbers are?

Now, leading on from Sourcrates' quote because it's good advice...

A DRO is a cut-down version of bankruptcy, introduced in 2009 for those in rented accommodation, less than 20k debt, below £50 per month surplus income and a car (if any) worth less than 1k. Payplan can do them but CAB do most.

CCA is shorthand for 'a formal request for a copy of your original consumer credit agreement under s77-9 of the consumer credit act'
