Attachment of Earnings Paid

Hi All
I have had an Attachment of Earnings for council tax since January, paying back 1360.84 over 4 pay days Jan-Apr.
This is now complete, however, I received a letter on Friday from the Council claiming i still owe them 236 pounds and that this is in Court Proceedings.
As the original amount (1360.84) on the AOE was paid, would the council have to take out a new Court Order in order to reclaim the 236?
I have tried to speak to them but am getting nowhere.
This is a new claim and have no idea where this figure has come from and Friday was the first time i was advised about it.
Any advise would be most appreciated, thank you

you need to speak to them a.s.a.p.
the council will go the full hog with court to make an example of you, but they need to provide a monthly breakdown or where this has come from?
Just a though have they added the court costs onto your old debt,0 -
Hi Teddyturner,
I would suggest that you write or email the council and ask for clarification. We can only speculate about what this £236 could be - it could be court costs or even another debt from another tax year but the most important thing is that you get clarity ASAP.
Send them a copy of the letter that you had in January confirming the outstanding balance was £1360.84, then photocopy your 4 payslips showing the deductions that equal this balance. State that you can clearly demonstrate that the debt has been paid and, therefore, if they want to chase you for any other money they will need to give you more information otherwise you will escalate matters to the Local Government Ombudsman. It all depends what the letter you received was . A summons, a regulation 36 notice ( a 'request for information form') etc. ?
Have you being paying this years council tax ? = £236 is roughly 2 months payments for a Band B property.
If you have been paying this years council tax then ask the council to check that your payments have been allocated correctly so that they have been going against this years charge. It's a common issue that occurs depending on the way the council has their system set up.
Another common problem we tend to see is that employers are quite often very bad at paying monies over to the council and it's often a long fight to get the money. If this is the case then it's not technically been paid until the council receive it however most suspend action if they had proof it had been deducted.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
