Phoenix recoveries! Help please

Time to ask for help agaiin...

some time ago I sent a CCA request to moorcroft, their response was sorry we cant provide this as we are no longer dealing with the account.

Today I have received a letter from Phoenix recoveries saying I must pay in full within seven days or call to make a payment arrangement and then the usual court threats.

What course of action do I take now? Thanks

    With whom did you have the original debt?

    There is also a letter to give notice of legal assignment of the debt due...etc
  • Well, I'm not sure if its the right thing to do but after reading through other posts I am going to send these new lot a CCA request and take it from there.

    Hi vordhosbn - I'm sorry that your thread does not appear to be getting much attention. Moorcroft are a particularily slippery crowd and it would be easy to think that there is some link, or at least collusion, between them and Pheonix Recoveries. I'm not sure on that, but would like to ask/clarify a couple of points.

    How long was it between you asking Moorcroft for a true copy of the original Consumer Credit Agreement and their reply, to you, that they were unable to provide the cca as they were 'no longer dealing with the account'? IF it was more than 12 working days, then Moorcroft were already in contravention of the conditions of the Consumer Credit Act and the 'agreement' would no longer be enforceable without a court order.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • The CCA request was received by moorcroft on the 25th june...they replied the same day they got it, just checked on the letter and it is dated 25th june also! I posted the request on the 19th june so it seems they were well within the time limit.
