Should a manager on TUPE transfer chair consultation meetings with other staff?

Hi,


Just asking this on behalf of someone else.

A friend who has a contract which has been lost has resulted in her being put forward for TUPE transfer. In reality she isn't costed into the contract, so it may well result in possible redundancy should the contract reject her as part of the TUPE process (something to do with % of her workload).

However she is also the one who is responsible to carry out the consultations for the TUPE transfer of her staff under her?

Is this legal to do, or should the company have someone else carry out the TUPE process as she is directly affected by this?

    There's no reason why she shouldn't. It's a management job and she's the manager. Happens a lot.
