Lowell defaults

Hi new to this so please forgive me if I miss things out..

I have two defaults added to my credit files from Lowell. First I knew about this was a year and a half after the accounts I had with provident had supposedly defaulted. I know I paid these accounts off but have no proof. I had been keeping a close eye on my credit as I was hoping to apply for a mortgage.

So the question is how likely am I at getting these removed? I have had no default notices either from Lowell or provident. Provident never added these to my files Lowell did over a year after they had supposedly defaulted which was sept 13 according to provident but it states on my files Jan 14 ( they were added to my files June 2015). I have asked for proof of default notices Lowell state they don't need to provide any and Provident state they don't keep copies so cant provide me with proof obviously they do have credit agreements as I did have loans with them. They sent me statements and to be honest I could have made better ones (basically a screen shot of a power point no account numbers or name ect).

I don't understand how Lowell can add default notices without first notifying me that they were going to do so Lowell state they did not add them but they did.

Any help would be greatly appreciated just wish I had kept the payment cards now. I have been arguing with Lowell for about 10 months now as they just keep treating it as a complaint so takes upto 8 weeks at a time for a response.

    Hi,

    Escalate your complaint to the financial ombudsman, or the information commissioner.
    Incorrect credit file information is usually dealt with by the ICO.

    I'm assuming Lowell are still asking you for money ?

    So complaint about unfair debt collection practices to FOS, and complaint about incorrect information to ICO.

    Complaints can be sent online, direct from there relevant websites.

    The default on your credit file and the default notice that the creditor is required to send in the post are actually two separate matters. The default notice they have to send to you in the post is a requirement before any legal action can take place (i.e take you to county court).

    Whereas the default on your credit file is normally done when the 'relationship has broken down'. The Information Commissioner has issued guidelines about when a default should be added to someone's file, which you can read here.


    If you believe the default is wrong then I would agree with sourcrates and look at escalating your complaint (especially if you are going around in circles with them) The key issue seems to be asking them to remove the default altogether because the debt has been paid - but it is quite likely you will be asked to provide proof of that- if you can't then the default may still stand and (worst case scenario) the debt may be deemed enforceable. If you can't get the default removed you could still ask them to amend the date in accordance with the guidelines. Good Luck,
