    You need to understand the pay holiday structure and put in a written claim for your holiday pay as a leaver.

    This letter will detail the holiday accrued and holiday paid with the shortfall being due on leaving.
  • Hi, I am in a very similar situation. Our financial year is September - August. I am contracted to work 39 weeks per year in which I will have done 34 weeks by the time I leave. Which is worked out roughly 87% of my contracted working year. . By the end of their financial year I will not have received 87% of my 'actual' salary! I feel very cheated. I also would like to know who has my retaining pay if they do not give me what is owed? Salary received in jpart of July and August is covered by the weeks worked over the year. How can they justify that by not working the 5 weeks to the end of term (to make 39) constitutes losing 2 1/2 months pay. Really feel as though I am working for nothing until I leave 😧

    PS .... I have worked for them over 10 years.

    I had a similar issue and successfully argued that my pay was accrued over 42.67 weeks but dispersed over 52 weeks and therefore if I left mid year there needed to be an adjustment.

    I did an Excel spreadsheet showing the difference in pay for someone who worked 3 separate terms and someone who was employed for whole year showing the difference in pay. I was a supply worker and threw in fact that effectively was being paid less than a permanent member of staff and that as I had worked in excess of 12 weeks this was illegal. I also showed them a scenario where due to hourly rate being near NMW they could violate that as well.
