Debt following Separation

Hi,
I am new to this forum so I hope you can help.

My wife and I have separated and she now has rented her own place, we have two children and she has now mentioned Child Maintainence.

The house and deeds are in my name and has been for 10 years, this is due to her Bankruptcy just after our son was born (Almost 10 years ago).

As she moved out, with that she has stated that she is not "in anyway" interested in what needs doing to the house, and what happens to it. Of course, if I sell it then she will be entitled to 50%, but what about any costs that any Maintainence costs e.g. Bathroom floor need re-tilling following years of heavy family use!

The fact that she lived in/used the property before moving out, does that mean she is 50% liable for those costs too?.....

Thanks in Advance...

    Hi lone ranger,

What you really need is proper legal advice. No one on here will be able to give you accurate advice tailored to your precise circumstances. Some of the advice given may be misleading and plenty of it will be just plain wrong.
Im a huge fan of these forums but getting this sort of advice from here is not a great idea.

    Agree with Andy above.

These are specific legal questions your asking, only a solicitor can give you advice on this, and only a court could ultimately decide how these costs are shared.

JMO IANAL ... Sell the house without doing the remedial work. You won't agree on who should pay. By selling the house at a lower price without that work, you can at least split the equity appropriately.
