HELP! 2 PCN's and County Court Letter!

I would appreciate any help regarding my situation.

Below is a letter I'm about to send to Euro Parking Services in Birmingham who issued the PCN's. Apologies for the length of this but it explains my situation in detail. I have received a County Court Business Centre claim form but not sure how to proceed as I have only recently received these letters due to moving house.

To Whom It May Concern,

I am writing this letter to inform you that I wish to appeal the above Penalty Charge Notices.

However, before I begin I would firstly like to state the fact that I had used the car park (where I received both PCN’s) for around 7 months, 5 times a week as I worked nearby. In those 7 months I did not once have any intention of not paying for my ticket. The only times I did not pay for a ticket is when the machine was out of order. I’ve attached a picture of just some of the tickets I happened to have kept to prove I was a regular user of the car park.

On the 18/09/15 I received a PCN for my vehicle with the offence ‘Parked without displaying a valid ticket/permit’. In this instance I went to pay for my ticket however several other drivers had informed me that the machine was not working and that I can use the machine across the road at Digbeth Hall. So I paid for my ticket and displayed it in my car, only to come back and find the PCN on my windscreen. The parking attendant also wrote ‘Digbeth Hall ticket not valid’ (see attached picture) which obviously was unbeknown to me at that time. Surely the fair thing for the attendant to do was inform me of this fact rather than presenting me with a fine, especially knowing I had paid for a ticket!

On the 08/12/15 I received another PCN with the same offence ‘Parked without displaying a valid ticket/permit’. On this occasion I did not pay for a ticket as the machine was out of order, instead I displayed a notice in my car dashboard stating the machine was out of order. If you check your records I think you will find around this time (and other occasions) the ticket machine was not working, in fact I clearly remember parking for about 3 consecutive days without paying as the machine had not been fixed. Previously when the machine was out of order I was with fellow users of the car park when one of them rang the number displayed on the machine to inform the person on the other side that the machine was not working, they were told to display a notice stating the machine was out of order. This was the same notice I had showing on the 08/12/15.

The reason why there has been a delay in me contesting these charges is because around the time of the tickets being issued I was in the middle of getting married, going on my honeymoon and moving house. I have only recently received a number of letters from yourselves, Gladstones Solicitors and County Court Business Centre regarding this issue.

I would like to finish off by reiterating the fact I had no intention of not paying for my parking tickets, I always did unless your machine was faulty. I am an honest individual who would not purposely avoid paying for my ticket however I refuse to pay the amount of £394.77 as this is beyond ridiculous and am willing to fight this if needs be.

For the reasons mentioned above, I look forward to receiving notification that the Penalty Charge Notice has been cancelled.

    the appeals letters for appealing pcn,s are there

    if its at court stage, its TOO LATE to appeal and you must defend, so then read the rest of my reply in that other thread

    plus they are NOT penalty charge notices , they are PARKING charge notices , or were, but they are now an MCOL

    And you are about to lose by default and get a CCJ, if you do not start researching better. You don't appear to have read the court paperwork?

    As Redx says, you can't appeal now. You must acknowledge the claim and then defend, as covered on LOADS of threads here. Please read the NEWBIES thread links under 'Small Claim?' then come back and read some court claim threads URGENTLY by searching the forum for 'claim defence' or 'court defence'.
