Hello all,
I wonder if you can help me.
I have just found out that, in June 2015, a CCJ was registered against my name.
In March 2015, I moved to another address and, due to a lot of stress etc, at the time, I didn't pass on my address to any of my creditors.
I have recently contacted all of my creditors to offer them monthly amounts in a self managed DMP. Most have accepted although one came back advising that a CCJ had been entered and I had been ordered to pay £50 per month. The total amount is for £1135.
They asked me to contact them within 14 days to arrange payment. I have done this, no less than 8 times and, I can either not get through or, am not getting answers to my various emails.
I'm not disputing I owe the money, not at all but, I wonder if, as I did not know about this happening (and if I did I would've contacted them straight away and sorted it), could I appeal against this? Again, I'm not trying to get out of paying the money, I will happily pay them at the £50 per month they want but, a CCJ is a massive hit on my already shot credit file.
I'd be grateful for any advice you might have.

Hi maggymaggy
You may well struggle to get this CCJ "set aside" - that is, be given another chance to respond to the court papers. The court will normally require some good cause to do this if you did not initially receive the claim forms e.g. an intention to dispute the debt. Moreover, if the creditor has issued the claim at the last known address it had for you at the time, the service of their claim will be deemed valid.
It will cost you £255 (reductions/exemptions may be available for those on low incomes) to apply for a judgment to be set aside, and even if the court does agree to it, it does not stop court action altogether - it simply means that the creditor can re-issue the claim in which case it would still end up affecting your credit file unless you could settle it very promptly.

Hi maggy
If you are on a DMP, your credit will already be hit hard, so the impact of the ccj probably won't make it much worse. Have you got any other defaults? They drop off 6 years from the start date so your credit rating should improve then.Debt -it's a fight that I'm winning, dealing with debt one day at a time.

Hi,
As others have said, your credit is shot anyway, so the addition of the CCJ wont make any massive difference to you.
Getting a set aside costs £255.00, as Dennis mentions above, and to be fair, in your case it would be a waste of time and money.
Only around 45% are successful, and all it does is put you back to square one again, the creditor can do it all over again, and get the same or similar judgement.
Make an offer to them in writing if the £50 is too much, where money and debts are concerned, everything should be in writing, not on the phone, as there is no record of what's been agreed.
If your happy paying £50, then just pay them, you don't need to have further contact with them.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
