Ombudsman help.

Hi.
To cut a very long story very short, I have had an ongoing case/appeal with the CSA since 2002/03. (seriously)
They assessed me wrongly right at the beginning and I appealed immediately ( within a week). Since then the CSA continually denied that I had appealed. At some point in 2012 they accidentally sent me a copy of a letter meant to have been sent internally which showed that I had appealed and that they hadn't acted on it.
At this point I was dealing with the Independent Case Examiner who ruled that there had been no misconduct on behalf of the CSA. I then went back to the CSA with the new evidence and asked them to allow my appeal as they had now proven that I had appealed and shown they were at fault. They refused, saying it was nothing to do with them.
I then went to the Parliamentary Ombudsman who refused to even look at the case due to them having a 12 month time limit. I appealed this, stating that it had taken me 10 years to get the evidence I needed to send to them and if that is the criteria for accepting a case then the CSA becomes unanswerable to them as all they have to do is do what they do best and ignore peoples communication for the required time. My appeal was refused on grounds it was out of time :mad:
does anyone know if that was in fact my final chance at resolution or is there somewhere else I can take it/another path I can go down?
This is an £11,000 error so I have no intention of stopping until the absolute death.

    Have you tried contacting a solicitor who specialises in CSA cases?
    I know most of them will offer telephone advice initially for around £35. They'll be able to help you with your options.

    1) Apply for re-assesment
    2) Change your screen name to something that is not personal (well only to you)
  • re-assessment is only effective from the date you apply. I overpaid for many years and it is this that I want back, I have been re-assessed since and all is well with that. I asked them to look again at the original appeal and do the correct assessment from that date, they point blank refuse to do this saying it is nothing to do with them as there is a time limit for appeals. ( even though they admit I appealed ) It is impossible to make them see or do anything other than send me a standard letter. I did have a solicitor dealing with it a few years ago but they virtually ignored everything she sent them or asked them, leaving gaps of several months until they replied by which time my solicitor had sent them 2 or 3 letters, each one at cost to myself. At that time we didn't have the admission so didn't have anything to take them to court with so all that was happening was that I was paying the solicitor to try to do something that couldn't be done so I stopped using her.

    Have you tried your local MP? Our initial MP wasn't interested but 2nd MP very helpful
  • I wouldn't worry about the ombudsman TBH, most of them are paid to uphold basic disputes and when it gets legally complicated they tend to shut the door in your face and not want anything to do with it and that's my experience of the ombudsmans service personally.


    Plus if they do take it on they will only tell you that CSA had a right to make that decision and the ombudsman cant overrule a decision a company or department had been entitled to make even though that decision was illegally made.
    Its the truth unfortunately the Ombudman services are a bit of a micky mouse complaints procedure TBH and one worth SKIPPING in my honest opinion.


    AS for the time lapse, I know the CSA and DWP and JCP can chase you for a debt that's 100yrs old if they wish and take you to court for it as statute of limitation don't apply to them, I wonder if this can be reversed back onto them? as your case could be statute barred.


    You need a solicitor or CAB advisor to point in you in the right direction.
