Yes, they will just say they didn't receive it otherwise (and still do even if it's recorded in some cases!).
They get away with it because a lot of people are intimidated or don't believe they would resort to underhand tactics, or both.0 -

If 1st Credit/Connaught supply you with the cca and details of the 'alleged debt' and, providing that you have not either made any payments towards, or acknowledged, in writing to the original creditor, the 'alleged debt', then it will probably be 'statute barred' under the terms of the Limitation Act, 1980, and, once you have informed the creditor that you do not intend to pay the 'alleged debt' because it is statute barred (the ONLY defence you need) then the creditor can no longer pursue you for payment.

If you only bought the TV 4/5 years ago (as per your other thread) it will not be statute barred, but lets pay on the CCA.If you've have not made a mistake, you've made nothing0 -
I have prepared a letter to send to them today recorded delivery so fingers crossed this matter can be finnaly resolved.

I received a letter from 1st credit demanding £3,953.89, which is a debt that I vaguely remember, 1st credit have offered to pay 50% (half) of the alleged debt, if I pay the other half within 14 days. This debt may be one from about 5/6 years ago , only the figure is much higher than I remember, what do I do? Thanks.Like good food and drink?

wonder if any one can give positive advice-received a statutory demand through letterbox-not even in envelope or a cover letter. The creditor is from an old friend of which the friendship has turned stale. My husband is self-employed and used to pay a small company to service plant/vans etc. He has now received this SD with invoices dating back to November 2006 for completed. The work stated on the invoices had not been carried out.
The SD was dated 14 days before we received this, which seems very odd.
I phoned the solicitors but all they wanted to do was argue with me.
I will dispute the amount £3,000-but can they still bankrupt me.
I wonder if any one can give me some advice.

That is very strange, chambers - I would take the document straight to CAB, as you need to verify its authenticity, plus the way in which it was 'served'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

sorry, for delay in reply - yes we disputed this due to invoices we did not agree to. we received a reply stating that the reasons we provided were not sufficient they did not contain enough detail and would not provide a full defence. we had to reply within 7 days with good reasons otherwise they would issue court proceedings against us.
We did reply within the 7 days stating that basically if the work had not been undertaken then no payment would be made. an invoice was not evidence.
This was 1st october - and to date we have not received a reply.
I thought the SD was already started at court.
what do you think?
