New on here!
I was hoping that someone may be able to advise me on my problem.
I have recieved a statuary demand from 1st Credit/Connaught Collections. The amount the they say that I allegedy owe is £860! I have had no previous letters requesting money and what its actually for!
I did once get a TV on credit, started to pay but unfortunately I became unemployed and left me struggling to pay. As time went on I heard nothing about it, then I recieve this stat demand saying that I owe this money, which left me feeling frightended and not knowing what to do! Again I gnored it, then they sent me a letter saying that as I have chosen to ignore them they have little alternative but to get a petition against me for bankruptcy!
I want to pay for this, really I do so they they stop hassling me, however I feel reluctant to pay £860 as I know the TV wasnt for this amount. I believe I have a right to write to them and request the credit agreement enclosing the £1 fee, as they have not actually stated what the debt was for. I also read that they have 12 working days to reply, if after then its over 30days they are breaking the law, is this true? if so Does that mean if the 30 days are up they cannot demand the payment?
Please help me!

When did you get this TV and how long ago did you stop paying for it?
Who wrote the Statuatory Demand. Did it come from a court of the DCA. It is only valid if it comes from a court
Technically, anyone can petition for bankrupty for a sum over £750, BUT
1. It will cost the DCA a lot of money in fees.
2. Unless you own a house or something else really valuable , they would only get a portion of any money from the bankruptcy, which is unlikely to cover the fees. So it does not make sencse for them to do this.
3. It is common but against the OFT Guidelines for DCAs to threaten people with BK, when they have no legal right to do this. If this debt is about to become stature barred, the DCA will threaten you with all sorts as they know that even a £1 payment will establish your liablity. Since they paid a few poinds for the debt, that means mega profits.If you've have not made a mistake, you've made nothing0 -
Looking at the stat demand it says * position or relationship to creditor: Debt Collection Agent. form 6.1
I bought the TV about 4/5 years ago, I made about 5 months payments.
Its really worrying me, I dont know what to do. The fact that this amount doesnt look realistic makes me suspicious, I dont even know if these people are legit, do you?0
